You found out your ex got a significant raise, a promotion, or a new higher-paying job. Now, you may be wondering if your child support payments increase due to this new income. This isn’t always the case, as child support payments do not automatically increase. It’s important to understand:

  • Whether a child support order changes automatically when your ex earns more
  • What qualifies as a “substantial change in circumstances” in Oklahoma
  • How courts treat raises, bonuses, and other income sources
  • How to formally request a modification and document your ex’s increased income

You do not have to determine what comes next on your own. Our team at Inner Vision Legal will walk you through any options and answer your questions. Reach out today to schedule a consultation and see how we can help.

Does an Increase in Your Ex’s Income Automatically Change Child Support?

A change in your ex’s financial situation does not trigger an automatic update to your existing child support order. The order stays in place exactly as written until a court formally modifies it.

This is one of the most common misconceptions parents face. Even if your ex is now earning significantly more than when the original order was established, you still have to go through the legal process to get a new amount set. Until a judge signs off on a modification, the original order stands.

When Does a Raise or Promotion Qualify as a Substantial Change in Circumstances?

Oklahoma courts require you to show a “material and substantial change in circumstances” before they will consider modifying a child support order. A minor pay increase alone may not meet this standard. Generally, courts look for changes that are:

  • Significant in amount: A small cost-of-living raise likely will not qualify, but a major promotion or career change that substantially increases income may.
  • Lasting: Temporary income spikes, like a short-term contract, are less significant than a permanent salary increase.
  • Relevant to the child’s needs: Courts consider whether the change actually affects what the child requires financially.

Oklahoma also has a three-year review provision, meaning either parent can request a review after three years have passed since the last order, even without proving a substantial change.

How Are Salary Increases, Bonuses, and Other Additional Income Considered?

Oklahoma child support calculations use gross income from all sources, not just base salary. This is an important part of the process, and many parents misunderstand it at first. Courts often consider:

  • Regular salary increases and promotions
  • Annual or performance-based bonuses
  • Commission income
  • Income from a second job or side business
  • Investment income or rental income

If your ex received a large bonus or recently started a high-earning side business, those figures can factor into a recalculated support amount.

How Can You Request a Modification and Prove Your Ex’s Income Increased?

To request a modification, you will need to file a motion with the court that issued the original child support order. Both parties typically exchange financial documentation, and the court reassesses the support amount using Oklahoma’s child support guidelines. Proving your ex’s income increased requires documentation. Useful sources include:

  • Recent pay stubs or employer verification letters
  • Tax returns from the past one to two years
  • Bank statements showing deposits
  • LinkedIn profiles or public records reflecting a job change
  • Business filings if your ex is self-employed

An attorney can help you gather and present this evidence effectively, and file the appropriate paperwork correctly the first time.
