Making the decision to divorce is never easy and often takes months or even years for people to act on. So, when you’re finally ready to move forward, hearing that you’ll need to wait before finalizing everything can feel frustrating and overwhelming. At Inner Vision Legal, we understand what you’re going through. While the waiting period may seem like an inconvenience at first, it’s actually an important time—and one that can be used to your advantage.

In this post, we will go over what to expect during Oklahoma’s divorce waiting period, why it exists, and how you can make the most of it to prepare for your next chapter.

How Long is Oklahoma’s Divorce Waiting Period?

Oklahoma law requires a 90-day waiting period after the initial filing for divorce when minor children are involved. This waiting period begins on the earliest of three key dates:

  1. The service of a summons,
  2. The first date of publication, or
  3. The respondent’s entry of appearance.

If there are no minor children involved, the waiting period is much shorter—just 10 days from the initial filing. However, even these time frames can vary under certain circumstances. For example, if both parties agree and the court deems it appropriate, the 90-day waiting period may be waived. Conversely, if one party contests the divorce or fails to meet certain requirements, the process may take longer.

Why Does the Waiting Period Exist?

The waiting period isn’t just a bureaucratic hurdle—it serves several important purposes:

1. Time for Reconsideration

Marriage is a significant commitment, and dissolution should not be taken lightly. The waiting period gives everyone time to reflect and ensure that divorce is the best path forward, especially when children are involved.

2. Child Welfare

When minor children are involved, the court prioritizes their well-being, ensuring that child custody, visitation, and support arrangements serve their best interests. The waiting period provides time for these sensitive issues to be addressed properly.

3. Financial Settlements

Dividing shared assets isn’t always straightforward. The waiting period allows time to organize finances, resolve disputes, and approach property division or alimony agreements with clarity.

4. Legal Requirements

During the divorce waiting period, you’ll need to exchange financial documents to ensure transparency and comply with Automatic Temporary Injunctions (ATIs), which protect assets and prevent big changes. If you have kids, the court may also require you to take parenting classes.

5. Court Efficiency

Finally, this period reduces undue strain on Oklahoma’s legal system by preventing rushed filings and ensuring that parties have time to comply with procedural and legal requirements.

How Can You Make the Most of the Waiting Period?

While waiting for your divorce to be finalized, there are several steps you can take to prepare yourself and make the most of this time:

  • Focus on Self-Care: Divorce is emotionally taxing, so it’s crucial to prioritize self-care. Take care of yourself physically, mentally, and emotionally.
  • Gather Necessary Documents: Use this time to gather important financial documents such as tax returns, bank statements, and property deeds. These will be necessary when negotiating settlements.
  • Develop a Post-Divorce Plan: Start thinking about your future and what you want it to look like after your divorce is finalized. Consider your housing, finances, and career goals.
  • Seek Support: Find people you can rely on for emotional support during this difficult time. This could include friends, family members, or a therapist.
  • Communicate with Your Attorney: Stay in touch with your attorney and communicate any concerns or changes in circumstances that may affect your divorce proceedings.
