While there is no doubt that divorce is stressful for the couple involved, the separation process can be even more devastating for children. Child custody plays a significant role in creating and maintaining a stable environment for children both during and after divorce proceedings. It is an incredibly important and often highly contested part of a divorce.

Attorney Rhonda G. Telford in Oklahoma City is knowledgeable about Oklahoma child custody laws. At Inner Vision Legal, we work tirelessly on your behalf to ensure that you are able to be with your children and provide them with the emotional support they need during this trying time in their lives.

WHO WE SERVE

Whether you are just starting the process of determining custody or trying to fix an arrangement that no longer works, our firm is here to guide you with clarity and compassion. We can help:

  • Parents who need a formal custody order but are unsure where to file, which forms to complete, or how the process even begins.
  • Divorcing parents who need a workable plan for where the children will live, when each parent sees them, and who makes the major decisions about school, health care, and daily life.
  • Unmarried parents who need a court order to establish paternity, custody, visitation, parenting time, or child support.
  • Parents who believe their child should primarily live with them because of safety concerns, instability, substance use, or the other parent’s conduct.
  • Parents who cannot agree on the schedule, school, medical care, or safety, and may need the court to help decide what is best for their child.
  • Parents who want to resolve custody through negotiation or mediation and need help making the agreement clear, realistic, and enforceable.
  • Parents facing relocation or long-distance custody, where a move or growing travel demands make the existing schedule difficult to maintain.

No matter where you stand today, we are ready to help you protect your child’s well-being.

TYPES OF CHILD CUSTODY

Child custody refers to the rights parents have to raise their child. Custody includes where the child physically lives, who the child can interact with, and who makes decisions about the child’s well-being.

Oklahoma law allows for several distinct types of child custody arrangements. Attorney Rhonda G. Telford in OKC can help you sort through the different options to find what will work best for you and your family’s needs.

Child custody arrangements include but are not limited to:

  • Joint custody: The parents share custody. This means both parents make decisions on behalf of their children, and both make decisions about how the children will be raised. The parents decide on a visitation schedule that works for everyone involved.
  • Sole custody: Sole custody means one parent has control over decision-making for the children. Visitation rights are typically granted to the other parent.

DETERMINING CHILD CUSTODY

Ideally, you and your spouse will be able to come to an agreement about custody on your own. Attorney Rhonda G. Telford in OKC is happy to assist you in that process.

If an agreement cannot be reached, then the court will decide how to award custody. The judge will keep several factors in mind and make a decision in the best interests of the children.

These factors include:

  • Each parent’s relationship with the children;
  • Whether there is a history of violence;
  • Whether there is a history of drug or alcohol abuse;
  • Each parent’s mental and physical health;
  • Whether there is a criminal record; and/or
  • The previous involvement of each parent in the children’s activities.

If only one parent is awarded custody, the other parent will be given visitation rights. Visitation may be supervised or unsupervised. The visitation schedule can also be decided by the court.

In Oklahoma, children can state a preference for which parent they would like to live with. This preference is given more weight once a child reaches age twelve (12) or older, but the judge is not obligated to go by the wishes of the child.
